A man who works in a retail drugstore at $3,500 a pop is facing a $3,500 charge for a prescription that could save his life.
Sildenafil, the generic name for Viagra, will be available without a prescription in August.
The FDA approved the drug in 2013 and has not yet approved it for recreational use, the man's lawyer said.
Sildenafil is the generic name for the drug sold in a number of retail drug stores, including Costco, Walmart, and Giant. The drug's active ingredient is sildenafil citrate, which is also sold as Viagra.
"It's a little bit different than the original branded prescription drugs," said Jamie Sorenson, a pharmaceutical specialist who was not involved in the suit.
"For the vast majority of men, generic sildenafil is not approved to treat ED or the symptoms of other conditions," Sorenson said.
The man is seeking $3,500 in damages for his wife, who suffered from a heart condition, stroke, and brain damage.
In a press release from Costco, the man, who was also named in the suit, said he was being held in a room at the pharmacy to prevent an employee from opening the door.
Sorenson said the woman was holding her wife's bed in her hand, and the man was holding an empty bottle of pills, one of which was for $3,500, and told her it would cost $4. The pills were to be delivered to her, and the woman had no idea it was a prescription.
A man who works for Costco said he was surprised when the woman told him she had ordered her pills because it was an expensive item.
He said the woman, who was 18 and had no family in the United States, was surprised when she bought the pills in a store.
He said he has been unable to get the pills for his wife in the past and is seeking compensation for his wife's medical bills and expenses.
The man said he is aware of his wife's injuries and will contact the FDA to discuss the matter.
Sorenson said the man's lawsuit could be filed in federal court in Connecticut or New York.
"The FDA is not aware of this particular case and I don't know if it is available in all states, but it is a case that's going to be decided by the FDA in one case," he said.
Sorenson said the man's claim could be filed in the United States District Court for the District of Connecticut, where he is a lawyer.
"This is an important case and one that's going to be a significant case for us, and I hope it will help the men who have suffered," he said.
In July, Sorenson and his partner, Daniel D'Agata, began working on a new drug for erectile dysfunction.
Both men have been seeking compensation for their wife's injuries, and they are each expected to seek out more money for their medical bills.
The man's lawsuit was filed in state court in New York state on Monday. He was appointed counsel in the suit and has since agreed to participate in the lawsuit.
Sorenson and D'Agata have been unable to get the man's wife the pills, and they were unable to get them in the future.
The FDA approved sildenafil in 2013, and it is expected to approve the generic in April. The drug is approved for the treatment of erectile dysfunction in men.
Sorenson said the man's lawyer was not sure how much damage the man will pay, and he believes he will have no option but to file a suit.
"The guy that I'm working for is not going to do anything right now that they won't do," Sorenson said.

Sorenson said he also has difficulty obtaining the pills for his wife.
